The joint venture (JV) of the four construction companies that worked on the Massachusetts Bay Transportation Authority’s (MBTA’s) Green Line Extension, has filed a lawsuit against the project’s engineer, alleging the firm’s designs led to increased project costs.
The plaintiff, GLX Constructors is a collaborative group of four construction companies comprising Fluor Enterprises, the Middlesex Corp., Herzog Contracting Corp., and Balfour Beatty Infrastructure. The defendant is STV Incorporated (STV), the project’s engineer.
According to a report by Boston Herald, the lawsuit claims the engineer violated several contractual obligations. As a result, legal action was initiated in the Suffolk Superior Court, with GLX Constructors seeking more than $35 million in damages.
The project, which is said to be valued at $2.3 billion, added new branches and stops to the Green Line, with GLX Constructors partnering with STV in 2017.
According to the report, court documents claim STV declined to reimburse GLX Constructors for the increased costs.
When The Construction Specifier contacted the joint venture (JV) for comment, Fluor Incorporated responded on behalf of the group, saying the JV is refraining from comment during ongoing litigation.
An STV spokesperson responded to The Construction Specifier’s request for comment: “STV is proud of this highly successful project and the critically important contribution of its design to that success. We are confident that these commercial disputes will be resolved in STV’s favor through the judicial process.”
